Silverleaf Club (“Silverleaf,” “we,” “our,” or “us) knows that you care about how your Personal Information (as defined below) is used, stored, and shared. We take your privacy and our obligations to protect Personal Information you may provide us seriously. We have adopted this Privacy Policy (“Privacy Policy”) to explain what information may be collected from you, how we may use this information, and under what circumstances we may disclose the information to third parties.
This Privacy Policy will apply to any information that you provide to us or that we collect about you when you use our application for mobile devices or visit our website, www.Silverleafclub.com (collectively, the “Platform”). It does not apply to information collected by (a) us offline or through any other means, including on any other website operated by us or any third party; or (b) any third party, including through any application or content (including advertising) that may link to or be accessible from or through our website. If you have questions, we will be happy to answer them. Our contact information is included in Section 14 below of this Privacy Policy.

Introduction. This Privacy Policy sets forth the general rules and policies governing your use of our Platform. Depending on your activities when visiting our Platform, you may be required to agree to additional terms and conditions. We keep this Privacy Policy posted on /club/scripts/site/privacy.asp and you should review it frequently, as it may change from time to time without notice. Any changes will be effective immediately upon the posting of the revised Privacy Policy. WHEN YOU ACCESS OUR PLATFORM, YOU CONSENT TO THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, IMMEDIATELY STOP ACCESSING OUR PLATFORM.

Collected Information. Our Platform has the ability to collect two types of information from and about you: (a) information that you provide that personally identifies you and (b) information that does not personally identify you that we automatically collect when you visit our Platform or information you provide us.

Personal Information: Our definition of personal information includes any information that may be used to specifically identify or contact you, such as your name, postal and email addresses, phone number, credit card information, etc. In certain circumstances, we may request, allow, or otherwise provide you an opportunity to submit your Personal Information in connection with a feature, a service, or some other aspect of our Platform (the “Personal Information”). For instance, you may:

Whether or not you provide this information is your choice; however, in many instances this type of information is required to participate in or purchase the particular activity or service or gain access to certain content on our Platform.

Non-Personal Information: Our definition of non-personal information is any information that does not personally identify you. Non-personal information can include certain Personal Information that has been de-identified; that is, information that has been rendered anonymous. We obtain non-personal information about you from information that you provide us, either separately or together with your Personal Information. We also automatically collect certain non-personal information from you when you access our Platform. This information can include, among other things, IP addresses, the type of browser you are using (e.g., Internet Explorer, Firefox, Safari, etc.), the third-party Platform from which your visit originated, the operating system you are using (e.g., Vista, Windows XP, Mac OS, etc.), the domain name of your Internet service provider (e.g., America Online, NetZero, etc.), the search terms you use on our Platform, the specific web pages you visit, and the duration of your visits. We collect this information:

When you submit information to us through our Platform, you should be aware that your information is transmitted across the Internet and that no method of transmission over the Internet is 100% secure. Although we take reasonable security measures to protect your information when we receive it, you also need to ensure you take appropriate steps to protect your information.

Use of Information. The Personal Information collected through our Platform is generally used to fulfill your requests for our products, programs, and services; to respond to your inquiries about our offerings; to personalize your online experience; and for other reasons naturally associated with the circumstances for which you provided the information. We also may use this information to later contact you for a variety of reasons such as customer service; offering you other products, programs, or services that we believe may be of interest to you; or communicating with you about content or other information you have posted or shared with us via our Platform. We may share your Personal Information with third parties such as our partners, contractors, vendors, consultants, and professional advisors to the extent necessary for them to perform services on our behalf.
In response to a legal process or law enforcement request, we may disclose Personal Information. We also may disclose Personal Information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use, or as otherwise required by law.
We use the non-Personal Information that we collect in a variety of ways, including to administer the Platform, help us analyze site traffic, understand customer needs and trends, carry out targeted promotional activities, improve the quality of the pages that make up our Platform, gather broad demographic information, and improve our Platform services.
We may use your non-personal information by itself or aggregate it with information we have obtained from others. We may share your non-personal information with our affiliated companies and third parties to achieve these objectives and others. In no event is this information matched to your Personal Information. Aggregate information is anonymous information that does not personally identify you.
Agents and contractors of Silverleaf who have access to Personal Information are required to protect this information in a manner that is consistent with this Privacy Policy by, for example, not using the information for any purpose other than to carry out the services they are performing for Silverleaf. We will not use or transfer Personal Information provided to us in ways unrelated to the ways described herein without also providing an opportunity for you to opt out of these unrelated uses.

Other Uses and Information IP Addresses. An IP address is a number that is automatically assigned to your computer whenever you are surfing the Internet. Web servers (computers that “serve up” web pages) automatically identify your computer by its IP address. Our servers typically log IP addresses when visitors request pages from our Platform. We collect IP addresses for purposes of system administration, to report non-personal aggregate information to others, and to track the use of our Platform. IP addresses are considered non-personal information and also may be shared as provided above. It is not our practice to link IP addresses to anything personally identifiable; that is, the visitor’s session will be logged, but the visitor will remain anonymous to us. However, we reserve the right to use IP addresses to identify a visitor when we feel it is necessary to (a) enforce compliance with our Platform rules and policies, (b) fulfill a government request, (c) conform with the requirements of the law or legal process, (d) to protect or defend our legal rights or property, our Platform, or other users, or (e) in an emergency, to protect the health and safety of our Platform’s users or the general public.

Cookies. “Cookies” are small text files from a platform that are stored on your hard drive. These text files make using our Platform more convenient by, among other things, saving your preferences for you. Cookies themselves do not typically contain any Personal Information. We may analyze the information derived from these cookies and other technological tools we employ (such as clear gifs/web beacons) and match this information with data provided by you or another party. We may provide our analysis and certain non-personal information to third parties (who may in turn use this information to provide advertisements tailored to your interests), but this will not involve disclosing any of your Personal Information. Please note that third-party content providers on our Platform also may use their own cookies and other technological tools that are subject to the third party’s privacy policies, and not this Privacy Policy. If you are concerned about the storage and use of cookies, you may be able to direct your internet browser to notify you and seek approval whenever a cookie is being sent to your hard drive. You also may delete a cookie manually from your hard drive through your internet browser or other programs. Please note, however, that some parts of our Platform will not function properly or be available to you if you refuse to accept a cookie or choose to disable the acceptance of cookies.

Email Communications. If you send us an email with questions or comments, we may use your Personal Information to respond to your questions or comments, and we may save your questions or comments for future reference. For security reasons, we do not recommend that you send non-public personal information such as passwords, credit card information, social security numbers, or bank account information to us by email. It is our standard practice to send you email regarding events, activities, and other club related matters and that you specifically consent to being contacted by email for such purposes. In certain instances, we may provide you with the option to set your preferences for receiving email communications from us; that is, agree to some communications but not others.

Other Disclosures. Notwithstanding anything herein to the contrary, we reserve the right to disclose any personally identifiable or non-personal information about you if we are required to do so by law with respect to copyright and other intellectual property infringement claims or if we believe that such action is necessary: (a) to fulfill a government request; (b) to conform with the requirements of the law or legal process; (c) to protect or defend our legal rights or property, our Platform, or other users; or (d) in an emergency, to protect the health and safety of our Platform’s users or the general public.

Deleting Information About You. Whether or not you provide Personal Information is completely your own choice. You are not obligated to answer any question presented to you on or through our Platform. You can review and change your Personal Information by logging into and visiting your account profile page. You can also send us an email at [please provide email] to request access to, correct, or delete any personal identifiable information that you have provided to us. We cannot delete your personal identifiable information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
You may opt-out from receiving future promotional information from us or direct that we not share your information with any third parties as set forth in Section 9 below. Whether or not you opt-out is your choice; however, in many instances this type of information is required to participate in a particular activity, realize a benefit we may offer, or gain access to certain content, services, or offers on our Platform.

Public Forums. We may offer blogs, message boards, bulletin boards, or similar public forums where you and other Silverleaf members can communicate. The protections described in this Privacy Policy do not apply when you provide information (including personal information) in connection with your use of these public forums. We may identify you using personally identifiable and non-personal information about you that is posted on a public forum. Any information you share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Platform.

Protecting Children. We take special care to protect the safety and privacy of children. Our site is a general audience site. Nevertheless, the features, programs, promotions, services, and other aspects of our Platform that require the submission of Personal Information are not intended for anyone under 13 years of age. No one under age 13 may provide any information to or on the Platform. We do not knowingly collect Personal Information from children under the age of 13. If you are under the age of 13, do not use or provide any information on this Platform or on or through any of its features/register on the Platform, make any purchases through the Platform, use any of the interactive or public comment features of the Platform, or provide any information about yourself to us, including your name, address, telephone number, e-mail address, or any screen name or user name you may use. If you are a parent or guardian of a child under the age of 13 and believe he or she has disclosed Personal Information to us, please contact us as provided in Section 14 below. If we learn we have collected or received personal information from a child under the age of 13 without verification of parental consent, we will immediately delete that information.

Keeping Your Information Secure. We have implemented security measures we consider reasonable and appropriate to protect against the loss, misuse, and alteration of the information under our control. Please be advised, however, that while we strive to protect your Personal Information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your Personal Information. In the unfortunate event that your Personal Information is compromised, we may notify you by e-mail (at our sole and absolute discretion) at the last e-mail address you provided us in the most expedient time reasonable under the circumstances; provided, however, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system as well as for the legitimate needs of law enforcement if notification would impede a criminal investigation. From time to time, we evaluate new technology for protecting information and, when we deem appropriate, will upgrade our information security systems.

Collection of Information by Third-Party Sites, Ad Servers, and Sponsors. Our site may contain links to other third-party platforms that we do not control or maintain. These platforms may have information practices different from ours. You should exercise caution and consult the privacy notices of all third-party platforms before accessing such platforms, as we have no control over information that is submitted to, or collected by, these third parties. We have no control over the privacy practices employed by any-third party platform or any third-party products or services. Therefore, we cannot be responsible for the protection and privacy of any information that you provide while visiting such platforms if such platforms are not governed by this Privacy Policy.

We will provide a list of the categories of Personal Information, if any, disclosed to third parties during the immediately preceding calendar year for third-party direct marketing purposes, along with the names and addresses of these third parties. This request may be made no more than once per calendar year. We reserve our right not to respond to requests submitted other than to the email or postal address specified above. Please include “California Privacy Rights” in the subject line and in your request. You must provide us with specific information regarding yourself so that we can accurately respond to the request.
The Platform collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device.
We do not resell Personal Information that we collect from any consumer.
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

California’s privacy law requires that we notify you if we provide you a program, benefit, or other offering, related to the collection, deletion, or sale of Personal Information, which it defines as a “financial incentive”. We may offer you certain financial incentives that may result in different prices, rates, or quality levels (for example, contests and referral programs). Through these offerings, consumers provide us with some Personal Information (e.g., names, emails, phone numbers) when they opt-in to our programs. There is no obligation to opt-in and consumers may opt-out at any time. The details of each program are contained in the program offering. We invest heavily in our marketing and brands, in part, so we can provide programs to our customers. Consumer data is valuable to our business only when it is combined with a sufficient number of other consumer data and after it is enhanced by our efforts herein described. The value to our business of any individual consumer’s Personal Information is dependent on a number of factors, including, for example, whether and to what extent you take advantage of any offerings, whether and to what extent you opt out of any offerings, and whether we are able to enhance the data through our efforts herein described. Our ability to create any value from the programs is heavily based on our ability to leverage said intellectual properties. We do not calculate the value of consumer data in our accounting statements.
You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you: (A) the categories of Personal Information we collected about you; (B) the categories of sources for the Personal Information we collected about you; (C) our business or commercial purpose for collecting or selling that Personal Information; (D) the categories of third parties with whom we share that Personal Information; (E) the specific pieces of Personal Information we collected about you (also called a data portability request). If we sold or disclosed your Personal Information for a business purpose, we will provide you with two separate lists disclosing such sales or disclosures, identifying the Personal Information categories that each category of recipient purchased or otherwise obtained.
You have the right to request that we delete any of your own Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.
An exception to your request may apply if retaining the information is necessary for us or our service provider(s) to:

Make other internal and lawful uses of that information that are compatible with the context in which you provided such information.
Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (A) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and (B) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to ninety (90) days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Governing Law and Enforcement of Privacy Policy. Use of the Platform is governed by United States law and the laws of the State of Arizona. If you are accessing the Platform from a physical location outside of the United States with laws or regulations governing personal data collection, use, and disclosure that are different from United States laws, you agree that by accessing the Platform, you are transferring your Personal Information to the United States and you consent to the application of the laws of the United States and the State of Arizona with respect to use of the Platform and any dispute regarding the Website or this Privacy Policy. Claims and disputes arising under or relating to this Privacy Policy are to be determined by binding arbitration in the State of Arizona in accordance with the rules of the American Arbitration Association. If any provision of this Privacy Policy is held by a competent jurisdiction to be illegal, unenforceable, or in conflict with any applicable law, the validity of the remaining portions or provisions shall remain in full force and effect.
